We are Victoria Walsh– The Believe Consultancy and ‘we’, ‘us’, ‘our’ and ‘ours’ refers to Victoria Walsh – The Believe Consultancy. By using, accessing, or submitting information to, this website, www.thebelieveconsultancy (the ‘Website’), or any part hereof, you confirm your agreement to the terms and conditions set out within this agreement (the ‘Terms’). If you do not agree to the Terms then desist from using the Website immediately. We may alter the content of the Terms at any time and you warrant that you will check the Terms each time prior to making use of the Website and that you will desist from using the Website if you do not agree to such revised Terms.

1 Website Use

1.1 You may make use of the contents of the Website for: (i) your personal development in your career or business, (ii) your business or organisational development and (iii) for other legitimate purposes that are related to the contemplation of entering into a contractual relationship with us; the term ‘Permitted Use’ shall be construed accordingly.

1.2 You will not upload, email, post or otherwise transmit any material that contains software viruses, computer code, files or programs, designed to damage, interrupt, or destroy the functionality of the Website or any computer hardware or software.

1.3 You are only permitted to print, or download to a single hard drive, contents from the Website for the Permitted Use. 2.1 All material produced by Victoria Walsh – The Believe Consultancy included on this website or supplied directly through coaching is the property of us unless unless otherwise stated.

3.1 Whilst reasonable efforts are made to ensure the accuracy of the information contained upon our Website we make no representation or warranty as to the accuracy of such information. The contents of the Website are for general guidance only and should not be relied upon, without obtaining verification of the same.

3.2 We make no warranty as to the security of the Website, nor that it is free from harmful impediments, including, but not limited to, viruses or Trojans.

3.4 You acknowledge that we are not liable for any losses suffered, whether such losses are direct or indirect and arising in contract or tort (including negligence), as may arise to you or any third party, out of your use of the Website. We do not exclude liability for personal injury, death or fraudulent misrepresentation or where exclusion of liability is otherwise prohibited at law.

  1. Privacy

4.1 We take the collection and storage of customer data seriously. We value your privacy and your right to keep your details private. Any personal information data submitted by you to us via our website and or other communication methods will be treated in accordance with EU General Data Protection Regulation (GDPR).

4.2 What personal information data do we collected about you? Personal Information data is collected by us when you register with us as a client, contact us as an enquirer, when booking FREE discovery calls, if you download one of our products (free or paid for), when purchasing a product/ service, when entering competitions and promotions and when participating in surveys. For ‘marketing purposes’ we collect your name and email via an online form hosted by MailChimp (The Rocket Science Group LLC). For ‘purchasers of products or services’ known as Clients we collect name, address, marital status, name of partner/spouse, number of children, date of birth, education level, employer name, length of service and employment position and questionnaire information when it is felt necessary for the service being supplied. This information is collected via a personal information sheet which is emailed to you and then kept password protected. You have the right to chose to omit any information and not answer specific questions. We collect information via 3rd party partner Acuity Scheduling Inc when booking FREE discovery calls and when booking appointments for speed and service – if you do not want to share data via this partner an alternative process for booking appointments will be offered. We collect data as part of behavioural profiling offered within some coaching programmes. This profiling is done in conjunction with Epic (Data Processor) and The Wiley Group (Data Sub Processor) under the name Everything DiSC Profiling. It is a client’s prerogative to decide whether to engage with this profiling and if they do not wish to share data in this way profiling will be removed from their programme. Each 3rd party operates their own data handling and privacy policy and we do not control these and it is strongly recommended that these are reviewed.

4.3 When submitting any personal information data you warrant that any information submitted by you, to, or via, the Website or via any information questionnaires, is complete and accurate in all respects.

4.4 By submitting your personal information data via our website or other communication methods such as personal information sheet or on-boarding questionnaire, you are giving consent to our processing of your personal information data. If there is data you wish to not disclose you have the right to retain this information. You agree that all personal information data may be held in our database with a view to us contacting you in the future, to identify you as a contracting partner, to establish a channel of communication with you via email or telephone, to send periodic emails to you, for other marketing purposes such as surveys and to serve you as a client should you purchase a product or service.

4.5 What do we use your information for? We only use this data for legitimate commercial interests. The information is used to personalise service and experience to cater for prospects and client’s specific needs.

4.5 How long do we hold on to your personal information? Personal information data for those purchasing products or services from us is retained for our records and documentation/invoices (unless you have specifically asked us not to) for 7 years. This is to ensure we maintain records of our contracts, invoices, proposals and projects. Information is then destroyed through deletion and shredding of any printed documentation. Personal information of those who sign up for ‘marketing’ via our online form will be kept for as long as you give consent in the form of opt-in.

4.6 We will not publish your personal information unless requested or consented to by you for a legitimate reason e.g. within a testimonial or a case study. We will never share your data with a 3rd party unless directly authorised.

4.7 Sharing information publicly on our website and on a social media page  – On our website we have a blog ‘inspiration’ which is public. Any information you include in a comment on any blog article posted may be read, collected, and used by anyone. If you chose to comment on our blog you accept that any personal information data you include will become visible to others. We also maintain a presence on social media platforms including Facebook, Twitter, Linkedin and Instagram. When posting comments, sharing information and communication via a social media platforms you do this at your own risk without any expectation of privacy. It is not within our control how the other users of these social media platforms may act nor can we control the actions the platforms themselves.

5. Marketing

5.1 We will send you information about products, services, inspiration, advice, promotions and other coaching/personal development material which may be of interest to you if you have consented to receive marketing through the process of opting in.  If you consent to receiving marketing you may opt out at a later date. You have the right at any time to stop us from contacting you for marketing purposes.

6. Access to your information and correction

8. General Terms

8.1 We may place links to third parties’ websites upon the Website and use social media platforms to communicate our messages. We do not monitor such websites and we take no responsibility for the contents of such websites. Our privacy policy only applies to our website and we recommend you check the privacy policy of all other websites you visit and engage with.

8.2 Any information or coaching support provided on our website is provided in good faith and is generic. We take no responsibility for any actions which individuals takes as the result of content provided on or via this website. Specific coaching support is given in accordance to a framework agreement coaching contract when purchasing our service or products. The framework agreement lays out responsibilities of all parties.
